Data Protection Officer

Under the Personal Data Protection Act (PDPA), all companies are required to appoint a Data Protection Officer (DPO).

What Is A DPO?

A DPO is an officer appointed by the company. It can be: 

  • A dedicated responsibility as a role
  • A dedicated responsibility added to an existing role within the organization
  • A role outsourced to service providers outside of the organization

DPO Qualification

As of October 2024, a DPO does not need to be a Singaporean citizen or resident, neither do they need any particular qualification.

A company can have more than one DPO, and an individual can serve as DPO for more than one company.

Official registration to act as a DPO can be done via ACRA using a company’s CorpPass or through a filing agent such as Lionsworld.

Obligations & Responsibilities of A DPO

Obligations

  1. Their business contact and informationmust be made publicly available. 
  2. They should be the key point of contact should a personal data breach be discovered. 
  3. They should be readily available and operational during the company’s working hours.

Responsibilities

  1. Monitor internal compliance of the company’s practices with the PDPA. 
  2. Efficient handling of inquiries regarding confidential data.
  3. Alert management of personal data risks. 
  4. Serve as a key point of contact for the Personal Data Protection Commission (PDPC).

Penalties

A company can be fined an undisclosed amount for failure to appoint a DPO and following the obligations as listed in the PDPA.
